Right of Withdrawal

For contracts concluded at a distance, the consumer in principle has a period of fourteen days to exercise their right of withdrawal, without having to justify their decision or bear any penalty, in accordance with article VI.47 of the Belgian Code of Economic Law.

The service provided by the publisher consists of generating digital content not supplied on a physical medium. By confirming their order and making payment, the user:

• expressly requests immediate performance of the service;
• acknowledges that their right of withdrawal is lost as soon as generation of the agreement has begun.

This exception is provided for in article VI.53, 13° of the Belgian Code of Economic Law.

"I request the immediate generation of my flatshare agreement and I acknowledge that, since this digital content is supplied immediately, I lose my 14-day right of withdrawal once the generation has taken place."

This wording corresponds to the explicit, not pre-ticked, checkbox that the user must validate before payment. In the absence of express consent, the service is not provided.

Once the agreement has been generated and activated, no refund can be obtained under the right of withdrawal. This rule applies whether or not the user has viewed the generated document.

If a technical fault attributable to the publisher prevents the generation or delivery of the agreement, the user may inform the publisher at info@pacte-coloc.be. A suitable solution or a refund will be offered depending on the circumstances.
